General Conditions of Service
The General Conditions of Service (hereinafter “GCS”) shall include general terms and conditions for the use of the webstore operated by raceXplus Kft (seat: H-1037 Budapest, Haránt köz 3/A; tax number: 28790697-2-41), as service provider (hereinafter “Service Provider”). Please use our services only if you agree with all its points and if you express your consent to be bound by them. This document shall not be filed, it shall be concluded only in electronic form (it shall not be considered to be a written contract), it shall not make references to the code of conduct.

GENERAL PROVISIONS
By issuing these General Terms and Conditions, the Operator shall lay down the terms and conditions related to the service and use of the racexplus.eu Webstore and Mobile Application, moreover, the rights and obligations of the Operator and the Customer. For any matters not regulated by this agreement, the Hungarian legislation in force at any time and the relevant provisions of the Civil Code shall apply.
By using the services of racexplus.eu and the Mobile Application (ordering goods, purchasing, submission of data), Customer shall accept automatically the conditions of this agreement. The Agreement shall be concluded with the order placed on the online interface of the racexplus.eu Webstore.
The copyright contents in the webstore and mobile application – including, but not limited to, texts, design, softwares, imagery, graphics, audio, audiovisual material, recordings, source code and content – shall be the property of the Operator. Without the Operator’s express written consent, modification, copying, duplication, republishing, uploading, downloading, transmission by post or in a different way, transmitting, presentation of the trademarks, service marks and contents or parts thereof contained in the webstore and mobile application shall be prohibited, in addition, it shall be permitted to make the same available to the public or to use or sell the same in order to create other works or to use the same for public or commercial purposes. Partly, contents for free use obtained lawfully from open source and content displayed on the basis of a separate contract from the Operator’s partners shall be subject to a different assessment. In this respect, copyright and industrial property rights shall not belong to the Operator (but to the owner of the content), however, downloading or any use of such contents from this website without the prior written consent of the rightholder and the Operator shall be also considered as infringement. The content of the website and the mobile application can be modified without prior notification. Unauthorized use of the website and mobile application and the improper use or forwarding of passwords and information related to the website shall be strictly prohibited.
Operator shall reserve the right to change these terms and conditions partially or entirely. The General Terms and Conditions (or any amendments thereof) shall enter into force upon publication.
PROCESS AND FULFILLMENT OF THE ORDERS
Operator shall sell entries in the Webstore for instant challenges. The content of the instant challenge shall be contained in the description. To take part in the instant challenge, the Customer shall register and shall be able to complete it at the place and time specified by the Customer, in any period breakdown. During the registration, the Customer’s delivery and billing data will be recorded. The place of performance shall be the country in the shipping address provided at the time of purchase.
The Operator shall provide a mobile application to complete the challenges, the User shall record the performance data only through this mobile application, and the User shall be able to track the status of its challenge therethrough. As other challenges can be completed indoor and outdoor as well, the data can be recorded using GPS positioning or manually. The challenge is considered to be completed if the condition of the challenge (e.g. to the entire distance swimming, running, cycling, etc.) has been fulfilled completely based on the data submitted via the mobile application. A confirmation email will be sent thereof. We shall not verify the authenticity of the submitted data and the real identity of the submitter, but we expect the principle of fair-play to be observed. If the User does not complete the challenge within 1 year from the date of the order, the Operator will not consider the challenge to be completed, however, the possible “challenge package” will be sent to the address provided during registration.
The User shall pay the mobile data roaming charges to the mobile or internet service provider. The mobile application shall not have any further facility charges.
A “challenge package” shall be a remembrance or items belonging to a given instant challenge (e.g. a coin, diploma) that will be sent by post to the User within 30 business days, after the completion of the challenge. The other element of the package shall be the “Partner Offers” which are available in the form of coupons and coupon codes in the Webstore after the completion of the challenge. The use of coupons and coupon codes shall be regulated by our partners, for which raceXplus Kft is not responsible. In case of any problems in connection with the partner offers, please let us know using the contact details.
RECEIVING ORDERS, CUSTOMER SERVICE
The racexplus.eu Webstore shall accept orders only electronically through its online system available at racexplus.eu web address, and shall not fulfill orders received by telephone, fax, email or letter. Until the examination of the data, the Operator shall reserve the right to suspend or cancel the orders which have been placed with false or clearly incorrect data.
The processing and delivery of the orders shall be during business hours on weekdays, and customer service shall be unavailable on weekends.

General deadline for completion within 30 working days of completion of the challenge (finishing). The completion of the challenge can be fulfilled through the racexplus mobile application. If the User does not complete the challenge within 1 year from the date of the order, the Operator will send “challenge package” to the address provided during the order and contract will be considered as completed.
The prices indicated in the Webstore are gross consumer prices which also include the packaging charges. The delivery shall be done by the service of csomagkuldo.hu, the amount thereof can be found in Price List: https://www.csomagkuldo.hu/webshopok/altalanos-szerzodesi-feltetelek-2018
The Operator shall make all possible effort to ensure that the relevant valid prices are included in the Webstore. However, if the consumer prices are incorrectly displayed in the system due to a technical error, the orders containing these data will be considered to be final only after consultation with the Customer.
The Operator shall indicate the name and description of the product in detail, and shall display a photo of the products in the Webstore. The pictures shown in the specification of the product may differ from reality, in some cases the same serve as illustrations.
If a special price is introduced, the Operator will fully inform the Users about the duration of the special offer.
If the Operator fails to fulfill its obligations under the contract because the product specified in the contract is not available, the Operator is obliged to inform the User immediately thereon and to refund the amount paid by the User without delay but no later than within thirty days.
MODIFICATION AND CANCELLATION OF THE ORDER
The finalized and sent order can no longer be deleted in the Webstore. For request, the entry can be deleted by the Operator via email during working hours. If the challenge has already been completed, the order cannot be canceled. Our Customers will be informed about the status of the challenge and order.
RIGHT OF WITHDRAWAL
Pursuant to Point m) of Section 29 (1) of the Government Decree 45/2014 (II.26.) “with regard to digital data content provided on intangible media, if the undertaking has started the performance with the express prior consent of the consumer and the consumer has stated at the same time that it acknowledges that it loses its right according to § 20 after the start of the performance.”, Customer starts the performance by using the raceXplus mobile application after registration and cannot exercise its right of withdrawal. At the time of purchase, the Customer shall acknowledge this by accepting the contract and shall give its prior consent.
PAYMENT METHODS
Credit card payment through the Paylike system
By credit card payment, you can purchase conveniently and securely in our store. You select the product/service in the webstore, the amount of which you want to pay by credit card. After this, you will be directed to the website of Paylike, which guarantees a secure payment and where you will need to enter your card details in order to start the payment. After the payment, you can return to the website of the webstore, where you will receive a confirmation of the result of the transaction.
RaceXplus Kft does not have access to or manage the data of the bank card or credit card under any circumstances. Your data will be managed through the safe system of Paylike. Banking partner- Paylike – the banking service is provided by Clearhouse A/S (FT-no. 22006) which is authorized by the Danish financial supervision and it is considered as a member of Mastercard and Visa Principal Member. Paylike supports the 3-D Secure system. The 3-D Secure service can be used with MarterCard and Visa. By enabling 3-D Secure, you can make your card transactions more secure. 3-D Secure is a protocol, the purpose of which is to increase the security of online card transactions. The security service works as “Verified by Visa” by Visa and “MasterCard SecureCode” by MaterCard. RESPONSIBILITY
The Operator shall not be liable if the User does not start, end, be injured or be forced to give up the instant challenge for any reason. If the User does not have insurance, the Operator shall not be liable for damages and costs arising therefrom.
Please pay particular attention to the protection of your own health and the health of others and always comply with the applicable laws!
COMPLAINT MANAGEMENT
If you receive a damaged, broken product, you have to notify the Delivery Company in all cases. Be sure to take a photo of the receiving and ask the Delivery Company for confirmation. If the product does not contain the ordered goods, please inform our customer service at hello@racexplus.eu.
Please do not return the package under any circumstances until it has been agreed with our customer service. Repayment is always made in forint (HUF). If the repayment does not appear in a HUF in the account, there may be differences due to exchange rate differences. We cannot provide its amount.
DATA PROCESSING RULES
The Operator treats the provided personal data confidentially, uses it exclusively for the fulfillment of orders, the provision and development of services and the production of its own statistics, and does not disclose it to third parties. You can read our privacy policy by clicking here.
Under legislation, our Users can anytime request the deletion of their personal data from our database. In the case of an ongoing challenge, it is possible to withdraw before the end of the challenge, in which case access to the mobile application and reception of medals or other accessories will be revoked and the entry fee will be refunded. Please note that if you cancel the registration, the previously placed orders will be lost and you will have to register again when you place a new order!
In order to purchase in the racexplus.eu Webstore, you must enable the use of cookies in your browser. Enabling the cookie only provides the continuity of the visit (with session identification).
MISCELLANEOUS PROVISIONS
This GCS is drawn up in Hungarian, in the interpretation thereof the rules of Hungarian law shall apply. For any matters not regulated by this GCS, the relevant provisions of the Civil Code shall apply.
